数据保护声明

用于收集欧盟在华食品推广活动源自欧洲的色彩食品与饮品相关活动数据

根据2018/1725[1]号条例,欧盟研究执行机构以下简称“机构”或“研究执行机构”)将会为其在中国举办的“源自欧洲的色彩”欧盟食品及饮品活动进行收集和处理您的个人数据。研究执行机构将使用外部承包商来组织和管理活动。

 

1. 我们为何要收集您的个人数据?

处理信息的目的是为了在中国推广的框架下组织以及收集活动反馈。基于此,个人身份数据识别处理将用于对参与者的邀请、获得场地平台、发送邀请函、准备参与者列表、获取访问各类平台的权限、制作活动报告、分发问卷、获得的反馈进行分析、活动跟进、分享相关推广信息、推广相关活动、照相各种形式的展示、在线直播和/或音频和视频记录所有人员例如厨师、演讲者和参与者,并在欧盟研究执行机构/欧洲委员会的互联网/内部网页上进行传播。

可能会涉及使用基于申请人在注册时提供的信息生成的邮件列表,以使数据控制方能够:发送匿名问卷以供参与者对活动进行评价、进行活动跟进、个人参与意愿的信息分享。

活动的具体特征是:组织安排消费者、零售商、贸易商、餐饮专业人士、欧盟和中国官员进行面对面或线上的交流。组织者使用GlueUp作为注册的平台,您可以这里找到他们的隐私政策。线上活动可以通过在线或录制的形式进行。

 

2. 谁来负责收集的过程?

数据控制方是欧盟研究执行机构(REA),由其负责人作为代表。鉴于组织管理需要,数据管理的角色由负责人委托给管理员,并由欧盟研究执行B4“农业食品推广、环境观察和创新治理”注册及注册纪录管理处负责人行使。

3. 收集信息的法律依据是什么?

1. 此收集信息活动基于:

* 条款51)(a)条,为执行符合公共利益或行使官方权利根据以下法律规定赋予欧盟研究执行机构而进行的履行符合公共利益的任务:

* 理事会条例(EC)第58/2003号规定了执行机构的章程;

* 欧盟委员会2021212日第2021/173号执行决定,设立研究执行机构并废除第2013/778/EU[2]号决定

* 委员会决定C20219522021212日),授予研究执行机构权力,以执行由欧盟总预算拨款的研究及创新领域的项目。

* 欧洲议会和理事会20141022颁布1144/2014号条例,关于在内部市场和第三国实施的有关农产品的信息提供和推广措施,并废除理事会第3/2008号条例(EC)。

*研究执行机构年度工作计划;

 

2.      条款第51)(b)条,基于数据主体的授权,用于以下具体目的:

  可对发言者和与会者演讲、在线直播进行录音、录像和图像/照片拍摄,并在研究执行机构 MyIntraComm研究执行机构 EUROPA网站和研究执行机构Twitter账户以及委员会的互联网/内联网网页上发布;

在有关活动的在线和纸质材料中刊登演讲者/主持人的姓名、照片、简短简历;

参加本次活动不以数据主体同意出现在图片和视听材料上为条件。您可能不同意出现在图片和视听材料上。

线下活动:当您进入活动场所时,请阅读拍摄和摄影通知。此通知是为了告知您进入可能发生摄影、音频、视频录制的区域。如果您不同意出现在图片和视听材料上,主办方将为您准备一枚徽章,以便在活动期间佩戴。为确保保护个人隐私,未经您事先书面批准,不得使用全名或个人特征识别图像。

对于虚拟/线上活动:如果您不同意出现在录制或流媒体会话中,您可以关闭摄像头并选择静音。

可以通过在注册表中勾选相关的选择框进行授权,明确同意在视听材料中出现。

您有权在任何时候撤回您的授权,而不影响撤回您的授权之前的处理的合法性。

 

4. 哪些个人数据将被收集?

在活动组织框架内处理的个人数据:

·        活动组织:国家、组织、职能、名字、姓氏、称谓、电子邮件、电话、照片/记录,如适用;

·       任何其他由数据主体直接提供的个人数据(如家庭住址、第二姓名等)或由在线应用程序自动收集的信息(如IP、地理位置),如适用;

·        交流目的:参与者(包括演讲者/主持人)的网络直播、图像和视频记录;活动的图像和视频记录可以发布在MyIntraComm(欧盟委员会的内部网络)上的研究执行机构内部网络、EUROPA的研究执行机构网页和研究执行机构的Twitter账户上;(非强制性的);

 

·        参与相关的非强制性数据:根据提供平台/应用程序的第三方的隐私政策,数据主体通过授权平台或其他在线应用程序在线共享的任何其他个人数据。请参阅下面的更多信息。

 

数据可通过在线网络程序(例如微信)或通过电子邮件交换或在活动期间收集。

5. 谁能接触到您的个人资料?

a.     在机构内,谁有权查阅这些数据?

以下类别人士将有权查阅您的个人资料:

·       负责组织和管理活动的欧盟研究执行机构授权人员或;

·       经授权的研究执行机构通信部门的工作人员可以在活动结束后获取图片和视听资料,以供后续交流之用。

b.     谁可以在机构以外访问这些数据?

以下类别的人士将有权查阅您的个人资料:

·        外聘承办商及本地分包商的授权员工(如活动管理机构、餐饮服务机构(可能处理与膳食/饮食偏好有关的数据)、旅行社(可能处理与旅行/住宿有关的数据);

·        欧盟委员会授权的工作人员或与活动组织相关的其他机构的授权工作人员;

·        为制定政策而被授权的欧盟委员会工作人员;

·        欧盟委员会授权的第三方平台供应商(如注册用GlueUpMicrosoft Teams微信)。

 

数据跨境移交

在本声明条款下,您个人的数据将会移交给第三国家,如果您的个人数据发生跨境移交,将按照本条例第五条的规定处理。

6. 您的个人数据信息将会被保存多久?

我们保存您个人数据信息的时间规则如下:

您的联系信息用于组织和管理会议或活动,将在处理过程完成后删除,但已授权接收有关其他活动信息和/或接收推广信函等的参与者除外。 

个人数据只用于活动期间拍照和视频拍摄:

        活动期间拍摄的照片和视频等资料保存时间为活动结束后五年;

        直播视频和在线会议/活动相关资料在删除前最多保存五年。

您有随时撤销隐私授权的权利,不影响您在撤回授权前所进行的相关程序的合法性。

为开展活动而与选定承办商共享的个人资料,会在活动或会议举办期间保留,并会由服务供应商根据相应的合约义务及条文予以删除;

7. 您有哪些权利?

作为活动参与者,您有权随时撤销您对隐私声明的授权,该项操作不影响撤销前所有操作的合法性。

同意个人肖像出现在照片上和视频/录像中不是参加活动的必要条件,您可能不同意个人肖像出现在照片和视频材料上,在这种情况下,您将获得一个胸卡,在活动期间,您须将胸卡佩戴在明显位置,正面朝外。对于虚拟/在线活动,如您不同意出现在视频或直播对话中,您可以关闭摄像机并将自己静音。

另外,作为活动参与者,您有权查看您的个人数据,如您的个人数据不够准确或不完整,那您有权提出更正请求。在适用的情况下,您有权要求限制反对处理,有权要求对数据持有方持有的您的个人数据进行复制或删除。您的请求将在收到后一个月内得到处理,不会延迟。

如果您想了解您的哪项个人数据由负责的持有方储存、修改、更正或删除,您可给我们的邮箱rea-agri-events@ec.europa.eu发送邮件,明确提出您的请求。

请注意要求删除信息的后果,删除信息意味着所有关于您的联系信息都将丢失。

您的个人数据将不再用于任何一项包含分析行为在内的自动化决策。

Data Protection Notice

For collecting data in the events of the EU food and beverages Colours by Europe Communication Campaign in China

 

Based on the Regulation 2018/1725[3] (hereinafter the Regulation’), the European Research Executive Agency (‘Agency’ or ‘REA’) collects and processes your personal data necessary for the organization and management of the EU food and beverages Colours by Europe Communication Campaign in China organized by REA. REA uses an external contractor to organize and manage the events.

 

  1. Why do we collect your personal data?

The purpose of the processing is the organisation of activities in the frame of a communication campaign in China and its evaluation. For this, identification data are processed for the purpose to invite the participants to the meeting, have access to the venue and to the platform, to send invitations, to prepare lists of participants and have access to the platform, reports, to distribute the  evaluation forms, to receive feedback on revaluation, meeting follow-up, to send you incentives related to the event, to promote the activities linked to the event, to take photographs/pictures, to make presentations, live online streaming and/or audio and video recording of all actors such as chefs, speakers and participants and to publish them on the internet/intranet pages of REA/European Commission.

Further use of mailing lists produced on the basis of the information provided by applicants with their registration may occur in order to enable the data controller to: dispatch of anonymous questionnaire for the evaluation of the event by participants, event follow-up, and information sharing among individuals that expressed the will to participate to the event.

The specific features of this event are: The event is organised face to face or virtually with consumers, retailers, trade, f&b professionals, EU and Chinese officials. For the registration for the events, the organiser is using GlueUp paltform, please find their DPN here. The virtual event may be web streamed or recorded.

 

  1. Who is responsible for this process?

The controller is the European Research Executive Agency (REA), represented by its Director. For organisational reasons, the role of the data controller has been entrusted by the Director to the delegated controller and is exercised by Head of Unit of REA.B4 ‘Agri-Food promotion, Environmental Observation and Innovative Governance’.

  1. What is the legal basis to collect your data?

This processing activity is based on:

* Article 5(1)(a) of the Regulation, it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in REA by the following legal acts:

* Council Regulation (EC) No 58/2003 laying down the statute for executive agencies;

* Commission Implementing Decision (EU) 2021/173 of 12 February 2021 establishing the Research Executive Agency and repealing Decision 2013/778/EU [4];

* Commission Decision C(2021)952 of 12 February 2021 on delegating powers to the Research Executive Agency with a view to performance of tasks linked to the implementation of Union programmes in the field of research and innovation comprising, in particular, implementation of appropriations entered in the general budget of the Union;

* Regulation (EU) No 1144/2014 of the European Parliament and of the Council of 22 October 2014 on information provision and promotion measures concerning agricultural products implemented in the internal market and in third countries and repealing Council Regulation (EC) No 3/2008;

* REA Annual Work Programme;

 

2. Article 5(1)(d) of the Regulation based on the data subject explicit consent for the following specific purposes:

    to be included in the event participant list, which is shared with authorised persons for the event and a follow-up of the event

    to be included in the mailing lists produced to dispatch of anonymous questionnaire for the evaluation of the event,

    to be included in the mailing lists to receive relevant information concerning the promotion of agricultural products in the form of the newsletters and direct mailing.

    to be included in the mailing lists to receive invitations to future similar events that REA may organise;

    to be included in the mailing lists for being contacted in the context of the EU activities

    For communication purposes:

  audio and video recording and images/photos, presentations, live online streaming of the speakers and the participants may be taken and published on REA MyIntraComm, REA EUROPA website and on REA’s Twitter account and on the internet/intranet pages of the Commission;

• Publication of the speakers/moderators’ name, picture, short CV in the digital communications and paper materials about the event;

  

Participation to the event is not conditional to data subjects consent to appear on pictures and audio-visual materials. You may disagree to appear on pictures and audio-visual material.

For face-to-face events: When you enter the event premises, please read the Notice of filming and photography. This notice informs that you  enter in an area where photography, audio, video recording may occur. If you disagree to appear on pictures and audio-visual material, , you will be provided with a badge to wear visibly during the event.  To ensure the privacy of individuals, images will not be identified using full names or personal features enabling identification without your prior written approval.

For virtual/ online events: If you do not agree to appear in the recording or the streaming session you can switch off your camera and mute yourselves. 

 

You may give specific consent to appear in the audio-visual materials by ticking the relevant opt-in boxes in the registration form.

 

You have the right to withdraw your consent at any time without affecting the lawfulness of the processing before withdrawal of your consent.

 

  1. Which personal data are collected?

The personal data processed in the framework of the event organisation are:

 

 

The data may be collected via the on-line application (e.g., such as WeChat) or at a later stage via e-mail exchange or during the event.

Note that if you use on-line applications (such as WeChat), these  do not operate under the Commission’s or the Commission’s authorised contractor’s control and those third parties’ privacy practices may differ from this Privacy Statement. Neither the Commission nor the authorised contractor is responsible for these third parties’ privacy practices or related privacy statements. You need to remain aware of these third parties’ privacy statements when you login into the third parties’ on-line applications.   1. Who will have access to your personal data?

a.      Who will have access to the data within the Agency?

The following categories of individuals will have access to your personal data for this specific event:

·        Authorised staff of the REA Units responsible for the organisation and management of the event or;

·        Authorised staff of the REA Communication sector may access pictures and audio-visual material for subsequent communication purposes after the event.

b.     Who will have access to the data outside the Agency?

The following categories of individuals will have access to your personal data for this specific event:

 

INTERNATIONAL TRANSFER

Your personal data may be transferred to third countries identified in this notice. If the international transfer of your personal data occurs it will be dealt with in accordance to Chapter V of the Regulation.

 

  1. How long do we keep your personal data?

We are keeping your personal data for a period as indicated below:

• Contact details processed for the purpose of the organisation and management of the meeting or event will deleted after the last action of this processing operation, except from those participants that have given their explicit consent to receive information about other events and/or receive the newsletter etc. 

• Personal data resulting from the picture and audio footage activity:

        images and video recordings from events will be kept for up to 5 years after the meeting/event;

        recordings from web-streamed and online meetings or events will be kept for up to 5 years before being deleted.

You have the right to withdraw your consent at any time, without affecting, the lawfulness of the processing based on your consent before withdrawal:

• Personal data shared with selected contractors for organisational purposes, are retained during the event or meeting organisation period and will be erased by the service providers in accordance with the corresponding contractual obligations and provisions;

 

  1. What are your rights?

As a participant, you have the right to withdraw your consent at any time, without affecting the lawfulness of the processing.

The participation to the event is not conditional to participants’ consent to appear on pictures and audio-visual material. If you disagree to appear on pictures and audio-visual material, you will be provided with a badge to wear visibly during the event..For virtual/ online events, if you do not agree to appear in the recording or the streaming session you can switch off your camera and mute yourselves.

In addition, as a participant, you have the right to access your personal data and to request your personal data to be rectified, if the data is inaccurate or incomplete. Where applicable, you have the right to request restriction or to object to processing, to request a copy or erasure of your personal data held by the data controller. Your request to exercise one of the above rights will be processed without undue delay and within one month.

Should you want to verify which personal data is being stored on your behalf by the responsible controller, and have it modified, corrected or deleted, please send an e-mail to the functional mailbox rea-agri-events@ec.europa.eu and by explicitly specifying your request.

Attention is drawn to the consequences of a delete request, which means that all your contact details will be lost.

Your personal data will not be used for any automated decision-making including profiling.
